General notes

These general sales conditions (“General Conditions”) are governed by the Italian Consumer Code (Italian Legislative Decree No. 206/2005 and subsequent amendments) and by the rules on electronic commerce (Italian Legislative Decree No. 70/2003 and subsequent amendments and supplements) and apply exclusively to distance selling via the web of the Products shown on Products page of the Website, in correspondence with the “Add to basket” button.

In the event of changes to the General Conditions, as specified in the articles 3 and 4 of these General Conditions (see “Purchase Orders”), the General Conditions published on the Website at the time the Order is sent by the Customer (hereinafter “Customer”) will be applied to the purchase order.

Offer to the public

The Products and Services with the relative Prices as present on the Site, constitute an offer to the public in accordance with the methods specified in the General Conditions and on the Site itself. The conditions of this offer apply exclusively to purchases made on the website indicated above.

The purchase contracts stipulated on the Site and concerning the Products (hereinafter “Purchase Contracts” or simply “Contracts”) are concluded with Air Track Italia S.R.L..

Pricing

The delivery service (hereinafter “Delivery Service”) is free for Italy and for all the EU countries if the order amount is more than € 500, as indicated in the following articles of these General Conditions and as detailed in the Purchase Order.
The Price on the Website is applied to the Products at the time the Order is sent, without any consideration of previous offers or any price changes that occurred subsequently.

Purchase Orders

Purchase Orders must be made online through the order procedure (hereinafter “Order Procedure”) on the Site, on the Checkout page.
In order to proceed with the compilation of the Purchase Order, the Customer may alternatively follow the following procedures:

a) In the event that the Customer is already registered on the Site (hereinafter “Website User“), it will be sufficient to enter his/her login credentials (username and password) by entering them in the “Customer Area” page.
b) In the event that the Customer is not a Website User, it will be sufficient for him to insert the data necessary to make the Purchase into the specific form on the Checkout page.

Air Track Italia reminds the Customer that, before proceeding with the Purchase, he may at any time become a Website User by making the relevant registration via the page Customer Area.

The Customer correctly completes the Order Procedure if the Site does not show any error message.

The Purchase Agreement between Air Track Italia and the Customer will be deemed concluded upon receipt of the Order by Air Track Italia. In this case, Air Track Italia will provide confirmation of the receipt of the Order by sending an Order Summary e-mail (hereinafter the “Order Summary”) to the e-mail address used by the Customer for the purchase/registration on the site. This summary will detail the products and quantities selected, the relative prices, the billing data, the shipping address, the order number (hereinafter “Order Number”), the payment details.

Subsequently Air Track Italia will send the Customer an Order Confirmation email (hereinafter “Order Confirmation”) which will include the order details and the link to the General Sales Conditions and the Withdrawal Procedure of the site.

Air Track Italia reminds the Customer to check with the utmost attention and care about the correctness of the data contained in the Order Confirmation and to notify Air Track Italia of any corrections within 24 hours of receiving it.

It is possible that occasionally the Products chosen by the Customer are not in whole or in part available; in this case, Air Track Italia will send the Order Confirmation email as soon as the products chosen by the Customer will be present in the warehouse again.

The Order Number, generated by the system and communicated by Air Track Italia, must be used by the Customer in any communication with Air Track Italia.

Payment methods

The payment of the Order can be made at the time of the order or upon the receipt of the Order Summary sent by Air Track Italia to the Customer.
Payment can be made by credit card (Visa, Mastercard, American Express) or by bank transfer as indicated in the Order Summary e-mail and as specified below:
Account: Air Track Italia S.R.L. – IBAN IT38I0312701405000000001945 – BIC BAECIT2B, entering the Order Number in the description of the bank transfer.

Air Track Italia will issue an invoice for the Purchase Order, sending it via e-mail to the subject holding the Order.
For the issuance of the invoice, the information provided by the Customer will prevail. Air Track Italia therefore reminds the Customer to always check, with the utmost attention, the accuracy of the information provided.

Exports/exemptions and VAT concessions

Air Track Italia® Products are subject to the laws and regulations in force concerning customs and export control and therefore must be purchased, exported and used in compliance with these regulatory provisions.

Delivery Service

Air Track Italia will deliver (hereinafter “Delivery Service” or simply “Delivery”) by specialized carriers appointed by Air Track Italy (hereinafter “Carriers”), only in Italy and in the EU Countries.

At the time of Delivery, the presence of the Customer or a trusted person is required to check that the packaging is intact and clean and that the Products received correspond to the information on the Order.
In the event of visible defects, such as incorrect quantities and / or incorrect product and the non-integrity of the packaging, Air Track Italia asks the Customer or the person in charge of his trust to report the aforementioned anomalies on the transport document and to contact Air Track Italy by sending an email to info@airtrackitalia.com.

Air Track Italia delivers the Products purchased to the address indicated by the Customer, within 5 (five) working days from the completion of the order (e-mail “Completed Order”, later “Completed Order”).
This date has an indicative value only, therefore no responsibility can be attributed to Air Track Italia in the event of failure to comply with the same if the Delivery occurs within 5 days from the completion of the order.

The Delivery will take place without prior appointment and to the street level.
The Customer will be contacted at least 30 minutes before the carrier’s arrival time. Delivery will be made by courier between 8.00 am and 8.00 pm from Monday to Friday.
The Carrier will do n. 1 (one) attempt to deliver the Products to the address indicated by the Customer.

In the event of absence at the delivery, the Carrier will send the customer an email communication indicating the telephone number to contact or the link to be selected to arrange the second Delivery. After the second unsuccessful attempt, a new e-mail will be sent to the customer.

The Products will in any case be kept free of charge by the Carrier itself for No. 10 (ten) (calendar) days, starting from the date of dispatch by the Carrier of each of the 2 communications by email above, during which the Customer can contact him for further agreements.
After No. 10 (ten) days (calendar) of stock the Order will be automatically canceled and Air Track Italia will provide to notify the Customer of the cancellation with reimbursement of the value of the Order itself minus the storage costs, which will be charged to the Customer.

If the customer wants to check the status of his order he can use the page “Find your order” or contact us through the channels listed in the “Contact us” page of the Website.

Delivery costs

Delivery costs (hereinafter “Delivery Costs”) for Italy and for EU countries are charged to Air Track Italia as shown and detailed in the Purchase Order, in the Order Summary email and in the next Order Confirmation email.

The Delivery Costs in EU countries for orders with an amount lower than 500 euros, are charged to the Customer, as shown and detailed in the Purchase Order, in the Order Summary email and in the next Order Confirmation email.

Support for information and complaints

The customer can get information about the support services, including after sales service, as well as for forwarding any complaints (hereinafter “Support Services”) by contacting Air Track Italy via the channels listed in the “Contact us” page of the Website.

Purchase Order Cancellation

If the non-consumer customer (professional) wishes to cancel his order, he can proceed with the cancellation within the day following the payment, at no additional cost. In this case, Air Track Italia will refund the Customer the full amount paid by reimbursement on the same channel used for payment.

In the event of subsequent cancellation of the Order, Air Track Italia will refund the Customer the amount paid, using the same methods.

Right of withdrawal

If the Customer is a “Consumer”, as defined in article 3 of the Italian Consumer Code, he is entitled to the rights set forth in articles 52 and following of the Consumer Code, as amended by Italian Legislative Decree 21/02/2014 No. 21, and therefore the right to terminate the Purchase Agreement (hereinafter the “Right of Withdrawal”) for any reason, without explanation and without any penalties, as specified below.

The Withdrawal may have as its object all (Total Withdrawal) or only part (Partial Withdrawal) of the Air Track Italia® products purchased by the Consumer.

In the case of Products, the Withdrawal period expires after 14 (fourteen) days from the day on which the Consumer or a third party, other than the Carrier and designated by the Consumer, acquires physical possession of the Products (hereafter “Period of Withdrawal”).

The right of withdrawal is exercised by sending – prior to the expiry of the withdrawal period as indicated above – a withdrawal notice (hereinafter “Withdrawal Notice”) by paper mail addressed to:

The Notice of Withdrawal can alternatively be sent – within the same Withdrawal Period as indicated above – also via email to the following address: info@airtrackitalia.com or by filling out the form published on the “Contact us” page of the Website.

The Withdrawal Notice must specify the intention to withdraw from the Purchase and the Product or Products for which it intends to exercise the right of Withdrawal.

Following the correct exercise of the right of withdrawal, as outlined in the art. 52 et seq. of the Italian Consumer Code as just mentioned, Air Track Italia will forward the Practice Number to the Consumer via email.
This Number must be indicated by the Consumer at the time of return of the Product (s) (hereinafter “Return”).

The Return of the Product(s) must take place within 14 (fourteen) days from the date on which the Consumer communicated his decision to withdraw pursuant to art. 52 of the Italian Consumer Code just mentioned. This aforementioned deadline will be respected if the Consumer sends back the Product / s object of Withdrawal before the 14 days deadline.

The Consumer may return the Product(s) by providing for the relative shipment. To make the Return of Products easier, Air Track Italia provides its Consumers, upon request, with a paid transportation service dedicated to Returning the Product(s) subject to Withdrawal.
For any information relating to the costs and methods of transport for the Return of the Products, you can contact us through the channels listed in the “Contact us” page of the Website.

Air Track Italia reminds its Consumers that the transport costs for the return of the Product(s) subject to Withdrawal are borne by the Consumer and that the Return is under the complete responsibility of the Consumer himself.

Air Track Italia also reminds its Consumers, before the Return, to check that the Product(s) subject to Withdrawal is/are intact and in normal condition, inserted in the original packaging, complete in all its parts (including packaging and documentation).
Air Track Italia reminds its Consumers that in the event of Withdrawal exercised within the day following the date of conclusion of the Contract, the Consumer will not be burdened by the expenses related to the return of the Product(s) subject to Withdrawal.

Pursuant to current legislation, the Consumer will only be liable for the decrease in the value of the Product(s) resulting from its/their handling other than that/those necessary to establish the nature, characteristics and functioning of the Product(s).

If the Right of Withdrawal has been correctly exercised in accordance with the provisions of articles 52 et seq., Air Track Italia will reimburse the Consumer the full amount already paid for the purchase of the Products, within 14 (fourteen) days from the day on which he was informed of the Consumer’s decision to withdraw from the Purchase Agreement.
The amount will be reimbursed by the same means of payment used by the Consumer for the initial transaction, unless a different consumer request is expressed and on the condition that the Consumer does not incur any costs as a result of the reimbursement.

Pursuant to and for the purposes of art. 56 of the Italian Consumer Code as amended by Italian Legislative Decree n. 21/2014, Air Track Italia reserves the right to withhold the reimbursement until it has received the Products or until the Consumer has demonstrated that it has sent the Products, depending on which situation occurs before.
The aforementioned option will not be applied by Air Track Italia if the Consumer for the Return of the Product(s) has made use of the Delivery Service dedicated to the Return and made available by Air Track Italia.

Legal and Conventional Warranties

a) Legal guarantee for the Consumer Customer: The Consumer Customer (hereinafter “Consumer”), as defined in art. 3 of the Italian Consumer Code (hereinafter the “Consumer Code”, Italian Legislative Decree 6 September 2005, No. 206), has the right to avail of the legal guarantee provided by the Consumer Code itself to articles 128 to 132.

This Guarantee provides for, among other things, that the Consumer, under penalty of forfeiture, denounces to Air Track Italy the possible lack of conformity found by the Consumer in the product purchased within 2 (two) months of discovery (art. 132, Consumer Code). Following this complaint, the Consumer will have the right to request the repair or replacement of the Product, without prejudice to the other rights provided by the law in favor of the Consumer.

By virtue of the aforementioned legal guarantee, Air Track Italia is responsible for the lack of conformity which becomes apparent within 2 (two) years from the Product Delivery. Beyond this term, Air Track Italia, therefore, will not be responsible for the conformity defects found by the Consumer.

In the event of replacement or repair of the Product, the terms of the warranty relating to the Product given in replacement or resulting from the repair are the same as those of the original product. Therefore, the two-year total duration of the legal guarantee will in any case start from the delivery of the original product.
In order to take advantage of the guarantee, we recommend that you present the purchase document. In any case, for the regulation of the legal guarantee, please refer to the rules of the Italian Consumer Code referred to in articles 128 and following.

b) Legal warranty for the non-consumer customer (Professional): The Professional Customer, as defined in the art. 3 of Italian the Consumer Code, has the right to avail of the legal guarantee provided for in the Italian Civil Code. This warranty provides, among other things, that the non-consumer customer, under penalty of forfeiture, denounces to Air Track Italy any conformity defect found in the product purchased within 8 (eight) days of discovery.

The aforementioned legal guarantee is valid for a maximum period of 12 (twelve) months from Product Delivery. Beyond this term, Air Track Italia, therefore, will not be responsible for the lack of conformity found by the non-Consumer Customer.
In order to take advantage of the guarantee, we recommend that you present the purchase document.

c) Conventional Air Track Italyia® warranties: In addition to the legal guarantee provided by the Italian Consumer Code and as reported in letter a) above, Air Track Italia offers additional warranties on some types of Products (hereinafter “Air Track Italia® Warranty”), as indicated from time to time in relation to them, to guarantee maximum peace of mind in your purchases.

Air Track Italia® Warranty is valid from the date of purchase of the Product.

Customer data is processed by Air Track Italia in accordance with the provisions of the legislation on the protection of personal data, as specified on the “Full Privacy Policy” page of the Website.
